Trama

2152: Archer deve affrontare l'accusa di cospirazione contro l'Impero davanti ad un tribunale klingon. La sua unica speranza per evitare la pena capitale o la condanna ai lavori forzati a vita nelle miniere di dilitio di Rura Penthe risiede in un avvocato klingon con poco entusiasmo per il suo caso.

In questo episodio...

Archer viene accusato di aver cospirato contro l'Impero Klingon, per aver soccorso una nave di una colonia annessa all'Impero anni addietro e lasciata senza risorse.
Archer viene considerato colpevole e la condanna a morte viene commutata in condanna ai lavori forzati a vita su Rura Penthe per aver aiutato l'Impero in precedenza.
L'avvocato della difesa Kolos fa riferimento a due eventi narrati in altri episodi:
- I submit to this tribunal, that Captain Archer is guilty. Guilty of meddling in Klingon affairs on more than one occasion. In fact, I've discovered his name is well known to the High Council. The accused once stood before the Chancellor himself and exposed a Suliban plot that would have thrown the Empire into a civil war. (Broken Bow) [T:26:38].
- The records of the Imperial Fleet also mention this man. His ship was instrumental in the rescue of the Klingon raptor, the Sam Ra, from the dense atmosphere of a gas giant (Sleeping Dogs) [T:27:17].

Phlox finge che Archer sia infetto da zenopaldis athemia mentre è rinchiuso nel carcere. Sarebbe una malattia molto contagiosa alcuni sintomi della quale sarebbero febbre e vertigini, ma non sappiamo se questa malattia esista davvero.
Oltre all'ambientazione, il processo di questo episodio è simile a quello visto in Star Trek VI anche in altri particolari: in entrambi i casi, gli avvocati difensori hanno molto a cuore la sorte dei loro protetti e in entrambi i casi una sentenza di morte è stata convertita in carcere a vita su Rura Penthe. Inoltre, come in Star Trek VI, l'ufficiale scientifico dell'Enterprise gioca un ruolo fondamentale nella fuga dei prigionieri.

T'Pol individua nell'anello del pianeta un asteroide dietro cui nascondere l'Enterprise in direzione 227.4 [T:25:24].

Versione italiana

In occasione della prima trasmissione in Italia, questo episodio è stato trasmesso senza la sigla iniziale ed è stato unito a The Crossing, privato dei titoli di coda. Tra i due episodi, oltre la pausa pubblicitaria è stato trasmesso un breve stacco che mostra l'Enterprise mentre entra in curvatura e il logo «Star Trek Enterprise» accompagnati da un jingle tratto dalla sigla di apertura.

Kolos: You didn't believe all Klingons were soldiers?

Kolos: You could have destroyed the Vor'tas, why didn't you?
Archer: Because Captain Duras is not my enemy. [T:26.23]

Kolos: Now, all young people want to do is take up weapons as soon as they can hold them. They're told there's honor in victory, any victory. What honor is there in a victory over a weaker opponent? Had Duras destroyed that ship, he would have been lauded as a hero of the Empire for murdering helpless refugees. Oh.. we were a great society, not so long ago, when honor was earned through integrity and acts of true courage, not senseless bloodshed.
Archer: For thousands of years, my people had similar problems. We fought three world wars that almost destroyed us. Whole generations were nearly wiped out.
Kolos: What changed?
Archer: A few courageous people began to realize... they could make a difference. [T:29.56]

Mayweather: What's this Rura Penthe like?
T'Pol: It's quite inhospitable.

Archer: We have a saying on Earth: «You don't kick a man when he's down.»
Kolos: So, are all humans like this?
Archer: Like what? Fair?
Kolos: Stupid!
